This is the last Will and Testament of me RICHARD HIORNS of Horley in the County of Oxford Farmer

I give and bequeath to my Wife ELIZABETH HIORNS all my household furniture plate linen glass china books pictures prints wines liquors housekeeping stores and provisions and other effects of a like nature in or about my dwelling house at the time of my decease also my horse and carriage and the sum of One hundred pounds to be paid to her out of the first monies which shall come to the hands of my Executors

I bequeath to my Trustees hereinafter named the sum of Three thousand six hundred pounds Upon trust to continue the same on such investment as it may be at my decease or to call in and reinvest the same in the name or names of the Trustees for the time being of this my Will in or upon real securities in England or Wales and upon further trust to permit and impower my Wife to receive the annual income of the said money or the securities on which the same shall be invested during her life And after her death as to the sum of One thousand eight hundred pounds part of the said trust money Upon trust to stand possessed of the same for the benefit of my daughter ELIZABETH ANN HIORNS in manner hereinafter mentioned and as to the further sum of One thousand pounds part of the said principal sum of Three thousand six hundred pounds Upon trust for my Grandson JOHN RICHARD IVENS to be paid to him on his attaining the age of twenty one years with power to apply the income of such sum of One thousand pounds during the minority of my said Grandson for his advancement in life or otherwise for his benefit but in case my said Grandson shall not attain the age of twenty one years then I bequeath the same equally between my daughter ELIZABETH ANN HIORNS and my Son BARNES BORTON HIRONS Provided always and I hereby declare that my said Trustees shall stand possessed of the sum of One thousand eight hundred pounds hereby bequeathed to them for the benefit of my daughter ELIZABETH ANN HIORNS Upon trust as to eight hundred pounds part thereof for my said daughter absolutely and as to the sum of One thousand pounds residue thereof Upon trust to pay the income thereof as and when the same shall become due and not by way of anticipation in the proper hands of my said daughter to be enjoyed by her as an inalienable personal provision free whenever she shall be covert from the control and engagements of her husband and for which income her receipts alone shall be a sufficient discharge to my Trustees and after the decease of my said daughter In trust for the child if only one or the children if more than one of my said daughter equally and that the interest or interests of such child shall be absolutely vested at twenty one years or being a daughter at her marriage but in case there shall be no such child of my said daughter who shall attain a vested interest in the said trust fund then upon trust to divide the same sum of One thousand pounds between my Son BARNES BORTON HIORNS and my Grandson JOHN RICHARD IVENS equally

As to all the residue of the real and personal estate whatsoever and wheresoever which may belong to me at my decease I devise and bequeath the same to my Son BARNES BORTON HIORNS his heirs executors and administrators (absolutely except estates vested in me as Trustee or Mortgagee) Subject nevertheless to the payment of my just debts funeral and testamentary expenses

I declare that if my Trustees hereinafter named or any Trustees or Trustee to be appointed under this clause shall die or be unwilling or incompetent to accept or execute the trusts of my Will it shall be lawful for the competent accepting Trustees or Trustee for the time being if any whether retiring from the Office of Trustee or not or if none for the executors or administrators of the last deceased Trustee to substitute by any writing under their or his hands or hand any person or persons in whom alone or (as the case may be) jointly with any surviving or continuing Trustee my trust estate shall be vested

I devise all real estates which shall at my decease be vested in me as Trustee or by way of Mortgage to my Trustees hereinafter named subject to the equities affecting the same respectively

I appoint my said Wife ELIZABETH HIORNS and my said Son BARNES BORTON HIRONS and FREDERICK WILLIAMS of Horley aforesaid Gentleman to be Trustees Executrix and Executors of this my Will and lastly I revoke all former and other Will by me at any time heretofore made

In Witness whereof I the said RICHARD HIORNS the Testator have to this my last Will and Testament set my hand this Twenty third day of December One thousand eight hundred and sixty nine – RICHARD HIORNS

Signed by the said RICHARD HIORNS the Testator as and for his last Will and Testament in the presence of us present at the same time who at his request in his presence and in the presence of each other do hereto subscribe our names as Witnesses – JNO. KILBY Solr. Banbury – THOS. MACE his Clerk

This is a Codicil to the last Will and Testament of me RICHARD HIRONS of Horley in the County of Oxford Farmer Whereas since the date of my said Will my Wife has died And by my said Will I have directed my Trustees therein named to stand possessed of the sum of One thousand pounds in trust for the benefit of my Grandson JOHN RICHARD IVENS with remainder over now I do hereby declare that my said Trustees shall hold the further sum of Two hundred in addition to the said sum of One thousand pounds for the benefit of the said JOHN RICHARD IVENS to be held by them upon the same trusts as the One thousand pounds In all other respects I confirm my said Will

Proved at Oxford with a Codicil the Twenty fifth day of November 1871 by the Oath of BARNES BORTON HIRONS (in the Will written HIORNS) the Son, one of the surviving Executors named in the Will to whom Administration was granted Power reserved of making the like Grant to FREDERICK WILLIAMS, the other surviving Executor named in the said Will

The Testator RICHARD HIRONS was late of Horley in the County of Oxford, Farmer, and died on the Eighth day of March 1871 at Horley aforesaid
