This is the last Will and Testament of me THOMAS HARVEY DUTTON BAYLY of Ickwell House in the County of Bedford and Edwinstowe in the County of Nottingham Esquire that is to say I nominate and appoint my friends Lieutenant Colonel ROBERT HENRY LINDSELL of Fairfield near Biggleswade and CHARLES SAMUEL LINDSELL of Holme Esquire Executors and Trustees hereof and give each of them a legacy of one hundred pounds free of duty I give and devise all and every my messuages cottages lands tenements hereditaments and real estate whatsoever situate at or near Langford in the County of Bedford or in any adjoining Parish or place or wheresoever situate unto my uncle JOHN HARVEY of Ickwell Bury Esquire and his heirs but in case of his dying in my lifetime I give and devise such real estate and every part thereof with the rights members and appurtenances unto my cousin JOHN EDMUND AUDLEY HARVEY his heirs and assigns And I give and bequeath unto my faithful servant JAMES CHESSUM all my clothes and wearing apparel whatsoever and a suit of mourning to be provided for him And I bequeath to him the annuity or yearly sum of one hundred pounds to be paid by my said executors and trustees or the trustees or trustee for the time being of this my will to or for the said JAMES CHESSUM for his life by equal quarterly payments from and out of my general personal estate the first payment to be made on such one of the usual quarter days of the year which shall first happen after my decease the legacy duty upon such entire provision hereby made for the said JAMES CHESSUM to be also paid by my said executors out of my personal estate And I direct my said executors or other the trustees or trustee for the time being of this my will as soon as in their judgement may be most expedient to make sale by public auction of my stud of hunters and of any hounds that may belong to me together with the saddlery of every description and all other effects belonging to me as Master of the Rufford Hunt and to stand possessed of the net proceeds of such sale In trust to pay over the same to the Gentlemen forming the Committee of the Rufford Hunt in aid of the funds in their [hands] or committed to their management for maintaining and keeping on foot that establishment And I direct all other my live and dead stock farming and garden implements and utensils whatsoever with my household furniture and effects of that nature (but not my plate linen china books pictures and articles of an ornamental character hereinafter disposed of) to be sold and the proceeds of such sale to go into the residue of my personal estate And I give all such articles and effects above excepted as not for sale unto or according to the nature of such effects respectively to be held and enjoyed by or in trust for my said uncle JOHN HARVEY for his life and from and after his decease unto or for my cousin BEATRICE SUSAN AUDLEY HARVEY his daughter for her own use and benefit And as to all and singular the rest residue and remainder of my monies and securities for money goods chattels and effects whatsoever and wheresoever and of what nature or kind soever not hereinbefore disposed of subject to and after payment of my debts funeral and testamentary expenses and the legacies hereby given or to be given by any codicil or codicils to this my will I direct the same to be held by the trustees or trustee for the time being of this my will In trust for my said uncle for and during his life and from and after his decease unto or to be held for my said cousin BEATRICE SUSAN AUDLEY HARVEY for her separate use for her life and not to be subject to the debts control or engagements of any husband but in case of her marriage a proper and proportionate settlement to be made upon her and her children in the usual way or as my said trustees or trustee for the time being shall by and with the advice of Counsel think proper and expedient but if my said cousin BEATRICE should die without having been married I direct such trust property to go and be held and enjoyed as she may dispose of the same by her will or in default thereof unto her next of kin And I hereby devise to my said trustees all estate vested in me as a trustee or mortgagee whether in my own right or otherwise to be held by them upon the same trusts as I may hold the same respectively at my decease And I direct that the powers and provisions applicable to wills contained in an Act of Parliament called the Trustees Act of the twenty third and twenty fourth years of the reign of Queen Victoria Chapter 145 shall be applicable to this my will as if the same were herein repeated and set forth at large In witness whereof I the said THOMAS HARVEY DUTTON BAYLY the testator have to this my last will and This is a Codicil to my Will which bears date the 12th day of July 1870 and to be taken as part thereof I hereby revoke my bequest to the Rufford Hunt Committee and I give and bequeath to my faithful servant JOHN HAYES (commonly called SAM) the annuity or yearly sum of one hundred pounds to be paid in such manner as I had provided for my faithful servant JAMES CHESSUM deceased – T HARVEY D BAYLY – Signed by the testator in the joint presence of us who thereupon signed our names in his and each others presence this 20 th February 1888 – SARAH STREET of Edwinstowe House Notts – JOSEPH ANDERSON of Edwinstowe House Notts
